Course Description

On September 14, 2023, the IRS placed an immediate moratorium on the processing of new ERC claims for the remainder of 2022 and possibly longer. But there’s more than a moratorium involved. The announcement was accompanied by additional IRS warnings and clear indications of forthcoming initiatives intended to help filers who were pressured to file unwarranted claims.

Join us for this webinar where our presenter covers the full spectrum of trending ERC topics, including but not limited to the IRS reasons for creating the moratorium, processing times, what the moratorium means for pending claims, what you need to know if you haven’t filed a claim yet. The presenter will also cover the updated IRS FAQs and newly issued eligibility checklist along with the risks businesses face if they are lured into a bad claim. The presenter will discuss the forthcoming IRS settlement program for repayments of ill-gotten ERC funds, the IRS’s upcoming “withdrawal option” for those with pending claims and second thoughts, the IRS reminder of the ERC’s complexity and the risks for those who file questionable claims, and why a trusted tax professional is absolutely essential wherever you may be in the ERC process.

Learning Objectives:

  • Evaluate the current state of Employee Retention Credit claims and the various IRS responses to the current claim moratorium

  • Recognize business risks regarding bad claims and possible and forthcoming options for claim withdrawals and options

  • Give examples of ways that a trusted tax professional can assist with various aspects of ERC claims

When Ms. Sheppard joined Frost Law in 2016, she brought a unique perspective and particularly effective skill set acquired during her position as a Tax Attorney with the Comptroller of Maryland. Even in her early days at Frost Law, Ms. Sheppard was able to leverage these valuable attributes— understanding better than others at the firm exactly how the Comptroller would approach matters— to achieve better client results and enhance the overall firm reputation.

For the last two years, Ms. Sheppard has served as a Director in Frost Law’s Tax Controversy Practice Group, where she has been responsible for working on a wide range of tax matters, including, but not limited to, individual income and corporate income tax, sales and use tax, tax relief and collection issues, appeals, and state and local tax matters.

Additionally, Ms. Sheppard co-created Frost Law’s award-winning Pro Bono Program and continues to serve as the program’s manager—inspiring other attorneys to offer their time and skills to those in the community who need free legal services. While at Frost Law, Ms. Sheppard has been the proud recipient of distinguished awards, including the Ronald J Schiff award for pro bono work, Super Lawyers Rising Star of 2020-2021, and Best Lawyers ‘Ones to Watch’ for 2021-2023.
